Terms and Conditions:
EM @ENTERPRIZE acts as a legitimate third party introduction service for male escorts who seek to be actively placed on their database.
This agreement is herby made forthwith between EM@ENTERPRIZE (from hereon known as the "Agency") and any applicant whose name appears on a submitted registration form. (From hereon know as the "The Registered Escort")
It is agreed as follows:
1. The Registered Escort, must at all times notify The Agency immediately of any changes, whether it be personal circumstances, change of address, change of contact number or any other relevant information that we would need in order to supply you with work. Failure to do so might effect the ability of we The Agency in providing you with such work and we accept no responsibility for earnings lost through failure to comply with the above.
2. We The Agency are here to give you, The Registered Escort, a complete and authorized service at all times. We also decree no to divulge with any third party, your personal address details given on the registrations form, which are taken in - and remain in - the strictest confidence with ourselves.
3. Once you have signed this agreement you, The Registered Escort, have the right to terminate your position with The Agency at any time. To do this you must notify us in writing by post or fax stating that you wish to terminate this agreements forthwith and we will then confirm this with you personally upon receipt of such notice.
4. This agreement shall come into full force and affect from the date of acceptance by the Agency and shall continue unless terminated by the other party giving to the other not less than 24hrs prior written notice.
5. The Agency shall be entitled to make such alterations, enhancements, improvements or developments of or to the specifications of the service as it may deem fit, but shall give The Registered Escort reasonable notice of these changes prior to implementing the same.
6. Anyone who terminates their membership either by request or through failing to pay their monthly fee will be asked to register again with The Agency for a fee of $9.99 before their reinstatement on the active database can resume.
7. You The Registered Escort will endeavor to operate at all times in such a manner as to be deemed sensible and reasonable and undertakes not to use the service in such a manner as to constitute a violation or infringement of the rights of any third party.
8. We The Agency act as sole third party. The Agency will promote to clients who in turn will contact the selected registered escort.
9. You The Registered Escort will be solely responsible for your own declaration of taxes. However we The Agency will not be responsible nor will we bear any authorization of informing the relevant governing bodies or their agents.
10. The Registered Escort will be employed on a self-employed basis only. No commissions will be charged on your earnings by The Agency, except for a monthly membership fee of $9.99. The registration fee will be waived based on 6 months period membership. This can be cancelled at any time and registration fee won't be billed based on this period. 11. Nothing in the Agreement shall create, or be deemed to create, a partnership or the relationship of employer and employee between the parties.
12. We The Agency stress that in no way will we be responsible for any aspect of any incident in any form whatsoever that occurs with a registered escort, client or both.
13. Examples of earnings stated act simply as a guide only. Actual earnings potential will vary on an individual registered escort basis.
14. We The Agency cannot guarantee the amount of work, regular or otherwise that we are able to supply to each and every individual as this will depend solely on an individual registered escort basis.
15. Monies or parts thereof received for the initial registration may cover for immediate company costs and can go towards additional costs of any description such as new concepts, promotions ideas, etc.
16. You The Registered Escort may not at any time assign or otherwise dispose of your rights against us The Agency under this agreement.
17. Technical failure of management or other causes may prevent us from providing a service and we have no liability if events stop us The Agency from doing so.
18. We The Agency recommend that you the Registered Escort obtain some sort of personal insurance in case of minor accidents wile engaged in work supplied by ourselves, as we accept no responsibility from any such accident as stated in clause 12.
19. If you, the Registered Escort are found to be in breach of these terms and conditions we the Agency reserve the right to terminate this agreement by way of 24hr written notice to the contact address supplied.
20. Neither party shall be liable to the other for any loss or damage which may be suffered by the other party due to any cause beyond the first party's reasonable contact including, but not limited to, any act of God, inclement weather, failure or shortage of power supplies, flood, drought, lightning or fire, strike, lockout, trade dispute or labor disturbance, the act of omission of government, highways authorities, or other competent authorities, war, military operation, or riot, difficulty or delay by third parties in provision of necessary supplies.
21. Further and as separate obligation the Registered Escort from the date of termination of this Agreement, will not canvass or solicit in competition with The Agency either on his or its own behalf or on the behalf of any other person, firm or corporation whom the Registered Escort was involved with in the pursuance of this agreement, without written consent of the Agency.
22. If any provision of this agreement is found to be unenforceable or invalid, the validity of the remaining provisions shall not be affected. This Agreement and the conditions contained herein shall constitute the whole agreement between The Agency and The Registered Escort and no alteration hereto shall be valid unless made in writing and signed by the parties thereto.
23. This Agreement represents the entire agreement and understanding of the parties with respect to the subject matter hereof and supersedes all prior undertakings and representations, whether written or oral and this agreement may only be modified if such modification is in writing and signed by The Agency and the Registered Escort.
